1. Acceptance of Terms
Welcome to Global Poker. By accessing, browsing, registering an account, or using any part of the Global Poker platform, website, or mobile application (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these exhaustive Terms of Service (the "Terms"). If you do not agree to these Terms in their entirety, you are strictly prohibited from using the Service and must immediately discontinue access.
These Terms constitute a legally binding agreement between you (the "User", "Player") and Global Poker Digital Entertainment ("we", "us", "our"). We reserve the right, at our sole discretion, to modify, update, add, or remove portions of these Terms at any time without prior specific notice. The date of the most recent revision will be indicated at the top of this document. Your continued use of the platform following the posting of changes constitutes your acceptance of the revised Terms.
2. Eligibility and Jurisdiction
The Global Poker platform operates under a specific legal framework utilizing a sweepstakes model. As such, strict eligibility requirements apply:
- Age Requirement: You must be at least eighteen (18) years of age, or the age of majority in your jurisdiction of residence, whichever is older, to create an account and participate in any activities on the platform.
- Geographic Restrictions: Access to the Service is intended solely for residents of permitted jurisdictions within North America. Currently, individuals residing in the United States (excluding Washington, Idaho, and Michigan) and Canada (excluding Quebec) are permitted to create accounts. Access from restricted territories is strictly prohibited and constitutes a material breach of these Terms.
- Verification: We reserve the right to request proof of age, identity, and residential address at any stage. Failure to provide satisfactory documentation will result in immediate account suspension and forfeiture of any accrued virtual currency or pending prize redemptions.
3. The Dual Currency System
Our platform operates on a proprietary dual-currency model consisting of Gold Coins and Sweeps Coins. It is imperative that users understand the distinction between these two virtual items:
3.1 Gold Coins: Gold Coins are social virtual currency used exclusively for entertainment purposes within the platform. They can be acquired via the platform's cashier or through free daily bonuses. Gold Coins have no real-world monetary value, cannot be transferred between players, and can never be redeemed for cash, prizes, or any item of value outside of the platform.
3.2 Sweeps Coins: Sweeps Coins are promotional sweepstakes entries. They cannot be explicitly purchased. Sweeps Coins are acquired as a complimentary bonus accompanying certain Gold Coin acquisitions or via Alternative Methods of Entry (AMOE) as detailed in our Sweepstakes Rules. Sweeps Coins utilized in competitive gameplay that result in a winning outcome may be eligible for prize redemption, subject to rigorous playthrough requirements and identity verification.
4. Account Registration and Security
To access the full features of the Global Poker platform, you must register a User Account. You agree to provide accurate, current, and complete information during the registration process. You are strictly prohibited from maintaining more than one active account. "Multi-accounting" is a severe violation of our integrity protocols.
You are solely responsible for maintaining the confidentiality of your login credentials (username and password). You agree to notify our security team immediately of any unauthorized use of your account or any other breach of security. Global Poker cannot and will not be liable for any loss or damage arising from your failure to protect your login information.
5. Fair Play and Anti-Fraud Policies
The integrity of the game is our highest priority. By utilizing the Service, you agree to adhere to our strict Fair Play policies. Any attempt to manipulate the platform, employ automated software (bots), engage in chip dumping, or collude with other players will result in immediate and permanent account termination.
We utilize advanced behavioral analytics and device fingerprinting to monitor gameplay. If our security algorithms flag an account for suspicious activity, we reserve the right to freeze the account pending a full investigation. Funds or virtual currency associated with fraudulent accounts will be permanently confiscated without recourse.
6. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Global Poker, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; (c) any unauthorized access, use, or alteration of your transmissions or content.
7. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by individual, binding arbitration rather than in court. Class action lawsuits, class-wide arbitrations, private attorney-general actions, and any other proceeding where someone acts in a representative capacity are strictly prohibited under these Terms.
